PATENT WRITING & FILING

Patent Filing

Patent filing is the process of applying for a legal monopoly over an invention. This is done by filing a patent application with the relevant government agency, for example, the United States Patent and Trademark Office (USPTO), the European Patent Office (EPO), the Indian Patent Office (IPO), etc.

Einfolge has the required infrastructure, resources, and strategic attorney tie-ups to file patents at both the national stage and PCT levels. Our approach has been carefully shaped to take advantage of our unique combination of strategic insight, deep industry expertise and technology. We file national stage patents in the US, China, Japan, Canada, the UK, Australia, Europe, Germany, Brazil, India, Mexico, South Korea, Malaysia, Macau, Columbia, Saudi Arabia, the Middle East, Vietnam, the Philippines, South Africa and all other major countries.

Einfolge provides valuable guidance and assistance throughout the patent application process and ensures that the application is properly prepared and filed.

For those who seek to protect their invention in multiple countries, the PCT route is often the optimal choice. Einfolge specializes in both PCT and national stage filing, enabling clients to reduce additional costs and save 30–40% on expenses. With the necessary infrastructure, resources, and strategic attorney tie-ups, Einfolge is equipped to file patents in both national and PCT stages.

Patent application types

In terms of the types of patent applications, there are generally two types: national and international. National patent applications are filed directly with the national patent office of the country in which the inventor seeks protection. International patent applications, on the other hand, can be filed through the Patent Cooperation Treaty (PCT), administered by the World Intellectual Property Organization (WIPO), which provides a centralized platform for filing patent applications across multiple countries. In India, there are six types of patent applications available under the Indian Patent Law, each designed for different purposes. These include provisional applications, complete applications, convention applications, PCT national phase applications, divisional applications, and patent addition applications.

How Einfolge performs the process

Before filing a patent, Einfolge conducts a thorough patentability search to ensure that your invention is novel, non-obvious, and useful. Once we have determined that your invention is novel, we file the patent application with the relevant patent office in the country or region where you wish to protect it. After filing the patent application, the patent office will conduct an examination to determine if your invention meets the patentability requirements. If the patent office raises any objections or issues during the examination, we will help you respond to the office's actions. If your patent application meets all the requirements and the patent office is satisfied with the response to the office's actions, your patent will be granted. The patent owner will then have the exclusive right to make, use, and sell the invention for a specific period, typically 20 years from the date of filing.

It is important to note that the patent filing procedure may vary depending on the jurisdiction in which you are filing your patent application.
